Op-Ed: The CEROC

ដោយយល់ឃើញថា ការទទួលស្គាល់សេចក្ដីថ្លៃថ្នូរជាប់ពីកំណើត និង សិទ្ធិស្មើភាព និង សិទ្ធិមិនធាចលក់ដូរ ផ្ទេរ ឬ ដកហូតបានរបស់ សមាជិកទាំងអស់ នៃគ្រួរសារ មនុស្ស គឺ ជាគ្រឹះនៃសេរីភាព យុត្តិធម៌និង សន្ដិភាព ក្នុងពិភពលោក។ ដោយ យល់ឃើញថា ការមិនទទួលស្គាល់ និង ការប្រមាថ មើលងាយ សិទ្ធិមនុស្ស នាំឲ្យ មានអំពើព្រៃផ្សៃ សាហាវយង់ឃ្នង ធ្វើអោយ ក្ដៅក្រហាយ ដលើសតិសម្បជញ្ញះ មនុស្សជាតិ និង ថា ការឈានដល់ពិភពលោកមួយ ដែលមនុស្សទាំងឡាយ មានសេរីភាព ត្រូវបាន ប្រកាសថា ជាសេចក្ដី ប្រាថ្នាដ៏ខ្ពង់ខ្ពស់ បំផុត របស់ មនុស្ស ត្រូវតែ បានការពារ ដោយនីតិរដ្ធ ដើម្បីជៀសវាង កុំអោយ មនុស្ស បង្ខំចិត្តជាចុងក្រោយបង្អស់ បះបោរ ប្រឆាំង ទល់នឹង អំណាចផ្ដាច់ការ និង ការគាបសង្កត់។ ដោយយល់ឃើញថា ជាការចាំបាច់ ដែលត្រូវលើកស្ទួយការពង្រីកទំនាក់ទំនង ជាមិត្តភាពរវាងប្រជាជាតិនានា។ ដោយយល់ឃើញថា ប្រជាជាតិ ទាំងឡាយ នៃសហប្រជាជាតិបានប្រកាស បញ្ជាក់ សាជាថ្មី ក្នុងធម្មនុញ្ញសហប្រជាជាតិ នូវជំនឿរបស់ខ្លួន ទៅលើមូលដ្ឋាន នៃមនុស្ស លើសេចក្ដី ថ្លៃថ្នូរ លើតម្លៃ របស់មនុស្ស និង លើសមភាព នៃសិទ្ធិរវាង បុរសនិងស្រ្ដី ហើយប្ដេជ្ញាលើកស្ទួយវឌ្ឍនភាពសង្គម និង កម្រិត ជីវភាព រស់នៅ ឲ្យកាន់ តែប្រសើឡើង ក្នុងសេរីភាព កាន់តែទូលំទូលាយ។ ដោយយល់ឃើញថា ដោយសហប្រតិបត្តិការជាមួយ អង្គារសហប្រជាជាតិ រដ្ឋជាសមាជិក ទាំងអស់សន្យាធ្វើឲ្យ មានការគោរពជាសកល និង ការប្រតិបត្តិនូវ សិទ្ធិសិរីភាព មូលដ្ឋាន។ ដោយយល់ឃើញថា ការយល់ដូចគ្នា មួយ អំពីសិទ្ធិនិង សេរីភាព ទាំង នេះ មានសារះសំខាន់បំផុត ដើម្បីបំពេញ នូវការសន្យាខាងលើ។

សេចក្ដីប្រកាស ជាសកលស្ដីពំពីសិទ្ធិមនុស្សនេះ ជាឧត្ដមគតិរួម ដែល ប្រជាពលរដ្ឋ គ្រប់ៗប្រទេស និង ប្រជាជាតិ ទាំងអស់ត្រូវធ្វើអោយបានសំរេច ដើម្បីអោយ បុគ្គលគ្រប់ៗរូប និង អង្គការសង្គមទាំងអស់ ដោយរក្សាខ្ជាប់ខ្ជួន ជានិច្ចក្នុងស្មារតី របស់ខ្លួន នូវសេចក្ដី ប្រកាសនេះ ខិតខំប្រឹងប្រែង បណ្ដុះបណ្ដាលការគោរពសិទ្ធិនិង សេរីភាព ទាំង នេះ តាមរយះ ការបង្រៀន និង ការអប់រំ ហើយនិងខំប្រឹងប្រែង ធានាអោយមាន ការទទួលស្គាល់ និង ការអនុវត្តជាសកល និង ដោយស័ក្កិសិទ្ធិ នូចសិទ្ធិនិង សេរីភាព ដោយវិធានការជាតិ និង អន្ដរជាតិ ដែលមាន លក្ខណះរីកចំរើន ជាលំដាប់ ទាំងក្នុង ចំណោម ប្រជាពលរដ្ធ នៃរដ្ឋសមាជិក ទាំងក្នុង ចំណោម ប្រជាពលរដ្ឋ ដែនដី ដែលស្ថិតនៅក្រោម ដែនសមត្ថកិច្ច នៃរដ្ឋទាំងនោះ។

មាត្រា១

មនុស្សទាំងអស់ កើតមកមានសេរីភាព និង សមភាព ក្នុងផ្នែកសេចក្ដីថ្លៃថ្នូរ និង សិទ្ធិ។ មនុស្សមានវិចារណញ្ញាណនិង សតិសម្បធញ្ញៈ ជាប់ពីកំណើត ហើយគប្បី ប្រព្រឹត្ដ ចំពោះ គ្នាទៅវិញទៅមក ក្នុងស្មារតី ភាតរភាពជាបងប្អូន។

មាត្រា២

មនុស្សម្នាក់ៗ អាចប្រើប្រាស់សិទ្ធិនិង សេរីភាព ទាំងអស់ ដែលមានចែង ក្នុង សេចក្ដីប្រកាស នេះ ដោយគ្មាន ការប្រកាន់បែងចែក បែបណាមួយ មានជាអាទិ៍ ពូជសាសន៏ ពណ៏សម្បុរ ភេទ ភាសា សាសនា មតិនយោបាយ ឬ មតិផ្សេងៗ ទៀត ដើមកំណើត ជាតិ ឬ ទ្រព្យសម្បត្តិ កំណើត ឬ ស្ថានភាពដ៏ទៃផ្សេងៗ ទៀតឡើយ។ លើសពីនេះ មិនត្រូវធ្វើ ការប្រកាន់ បែងចែកណាមួយ ដោយសំអាងទៅលើឋានៈ ខាងនយោបាយ ខាងដែនសមត្ថកិច្ច ឬ ខាងអន្ដរជាតិរបស់ប្រទេស ឬ ដែនដី ដែលបុគ្គលណាម្នាក់ រស់នៅ ទោះបីជាប្រទេស ឬ ដែនដីនោះឯករាជ្យក្ដី ស្ថិត ក្រោម អាណា ព្យាបាលក្ដី ឬ គ្មានស្វយ័ គ្រប់គ្រង ក្ដី ឬ ស្ថិតក្រោម ការដាក់កម្រិតផ្សេង ទៀតណាមួយ ដល់ អធិបតរយ្យភាពក្ដី។

មាត្រា៣

បុគ្គលម្នាក់ៗ មានសិទ្ធិ រស់រានមានជីវិត សេរីភាព និង សន្ដិភាព ផ្ទាល់ ខ្លួន។

មាត្រា៤

គ្មានជនណាម្នាក់ ត្រូវស្ថិតនៅ ក្នុង ទោសភាព ឬ ស្ថិតក្នុង ភាពជាអ្នក បម្រើដាច់ថ្លៃឡើយ។ ទោសភាព និង ទាសពានិជ្ជកម្ម តាម គ្រប់ទម្រង់ទាំងអស់ ត្រូវហាមឃាត់។

មាត្រា៥

គ្មានជនណាម្នាក់ ត្រូវទទួលទារុណកម្ម ឬ ការប្រព្រឹត្ដិមកលើខ្លួន ឬ ទណ្ឌកម្ម ឃោឃៅ អមនុស្ស ធម៌ ឬ បន្ថោកបន្ទាប បានឡើយ។

មាត្រា៦

ជនគ្រប់រូប មានសិទ្ធិឲ្យគេទទួលស្គាល់បុគ្គលិកលក្ខណះ គតិយុត្ដរបស់ខ្លួន នៅគ្រប់ទីកន្លែង។

មាត្រា៧

ជនគ្រប់រូប មានសិទ្ធិស្មើគ្នា ចំពោះមុខច្បាប់ និង មានសិទ្ធិ ទទួលការការពារ ពីច្បាប់ ស្មើៗគ្នា ដោយគ្មានការរើសអើង។ មនុស្សគ្រប់រូបមានសិទ្ធិទទួលការការពារ ស្មើៗគ្នា ប្រឆាំង នឹង ការ រើសអើង ណា ដែលរំលោភលើសេចក្ដី ប្រកាសនេះ ព្រមទាំអ ប្រឆាំង និង ករញុះញង់ឲ្យមានកររើសអើង។

មាត្រា៨

មនុស្សគ្រប់រូប មានសិទ្ធិ រកដំណោះស្រាយ ស័ក្ដិសិទ្ធ មួយ នៅចំពោះមុខ សាលាជំរះក្ដី ជាតិ ដែលមានសមត្ថកិច្ច ចំពោះអំពើរទាំងឡាយណាដែល រំលោភ សិទ្ធិមូលដ្ធាន របស់ខ្លួន ដែលត្រូចបានទទួលស្គាល់ ដោយរដ្ធធម្មនុញ្ញ ឬ ដោយច្បាប់។

មាត្រា៩

គ្មានជនណាម្នាក់ ត្រូវបានចាប់ខ្លួន ឃុំខ្លួន ឬ និរទេសខ្លួន តាមអំពើចិត្តឡើយ។

មាត្រា១០

មនុស្សគ្រប់រូប មានសិទ្ធិស្មីគ្នា ពេញលេញ សុំឲ្យតុលាការឯករាជ្យ និង មិនលំអៀង ពិនិត្យរឿង ក្ដីរបស់ខ្លួន ជាសាធារណះ និង ដោយសមធម៌ ដើម្បីសម្រេច លើសិទ្ធិនិងកាតព្វកិច្ច និង លើភាពសមហេតុផល នៃការចោទ ប្រកាន់ទាំង ឡាយខាងបទ ព្រហ្មទណ្ឌមកលើខ្លួន។

មាត្រា១១

១. ជនណាដែលជាប់ចោទ ពីបទល្មើសព្រហ្មទណ្ឌ ត្រូវសន្មតជាជនគ្មានទោសរហូត ដល់ពិរុទ្ធភាព ត្រូវបានរកឃើញ នៅក្នុង សវនាករជាសាធារណះដែលមាន ការធានាចំបាច់ ដើម្បី អោយ ជននោះការពារខ្លួន។

២. គ្មានជនណាម្នាក់ ត្រូវបានផ្ដន្ទាទោសពីបទល្មើស ព្រហ្មទណ្ឌ នៅពេលធ្វើអំពើ ឬ មានការខកខាន នេះ ដូចគ្នានេះដែរមិន ត្រូវមានការផ្ដន្ទាទោសឲ្យធ្ងន់ធ្ងរជាងទោសដែលបានកំណត់ឲ្យអនុវត្តក្នុងអំឡុងពេលដែលបទល្មើសបានកើតឡើងនោះឡើយ។

មាត្រា១២

គ្មានមនុស្សណាម្នាក់ ត្រូវរងការរំលោភ ជ្រៀតជ្រែកតាមអំពើចិត្តក្នុងជីវិត ឯកជនគ្រួសារ ទីលំនៅ ឬការឆ្លើយឆ្លង ឬការធ្វើឲ្យបះពល់ ដល់កិត្តិយស និង កេរ្ដិ៍ ឈ្មោះ របស់ខ្លួន បានឡើយ។ ជនគ្រប់រូប មានសិទ្ធិ ទទួលការការពារំពីច្បាប់ ប្រឆាំង នឹងការជ្រៀតជ្រែក ឬការប៉ះពាល់បែបនេះ។

មាត្រា១៣

១. មនុស្សគ្រប់រូប មានសិទ្ធិធ្វើដំណើរ ដោយ សេរី និង មានសិទ្ធិជ្រើសរើស និវេសនដ្ឋានក្នុងរដ្ឋមួយ។ ២. មនុស្សគ្រប់រូប មានសិទ្ធិចាកចេញពីប្រទេសណាមួយ រួមទាំង ប្រទេសរបស់ខ្លួនផង និង មានសិទ្ធិវិលត្រឡប់មកប្រទេសរបស់ខ្លួនវិញ។

មាត្រា១៤

១. មនុស្សគ្រប់រូប មានសិទ្ធិ ស្វែងរក និងទទួល កន្លែងជ្រកកោន ក្នុង ប្រទេស ដទៃទៀត ក្នុងករណីមានការធ្វើទុកបុកម្នេញមកលើខ្លួន។

២. សិទ្ធិសុំជ្រកកោននេះ មិនអាចលើកមក សំអាងបានទេ ក្នុងករណីមានការចោទ ប្រកាន់ ដែលពិតជាកើតឡើង ពីបទល្មើស មិនមែននយោបាយ របស់សហប្រជាជាតិ។

មាត្រា១៥

១.មនុស្សគ្រប់រូប មានសិទ្ធិ ទទួលបានសញ្ជាតិមួយ។

២.គ្មានជនណាម្នាក់ អាចត្រូវដកហូតសញ្ជាតិ ឬ រារាំង សិទ្ធិប្ដូរសញ្ជាតិ របស់ខ្លួនបានឡើយ។

មាត្រា១៦

១. មនុស្ស ប្រុសស្រីដល់អាយុគ្រប់ការ មានសិទ្ធិរៀបអាពាហ៍ពិពាហ៍ និង កសាងគ្រួសារ ដោយមិនប្រកាន់ពូជសាសន៍ សញ្ជាតិ ឬ សាសនាឡើយ។ មនុស្សប្រុសស្រី មានសិទ្ធិ ស្មើគ្នាក្នុងការរៀបអាពាហ៍ពិពាហ៍ ក្នុងចំណងអពាហ៍ពិពាហ៍ និង ក្នុង ពេល រំលាយ ចំណងអាពាហ៍ពិពាហ៍។

២. អាពាហ៍ពិពាហ៍អាចនឹងប្រព្រឹត្ត ទៅបាន លុះត្រាតែមាន ការព្រមព្រៀង ដោយ សេរី និង ពេញលេញពីអនាគត់ប្ដីប្រពន្ធ។

៣. គ្រួសារ ជាអង្គភាពធម្មជាតិ និង ជាអង្គភាពមូលដ្ឋាននៃសង្គម ហើយ គ្រួសារ មាន សិទ្ធិ ទទួលការការពារ ពីសង្គមនិង រដ្ឋ។

មាត្រា១៧

១. មនុស្ស គ្រប់រូប ទោះតែម្នាក់ឯងក្ដី ឬ ដោយរួមជាមួយ អ្នកដ៏ទៃក្ដី មានសិទ្ធិជាម្ចាស់ កម្មសិទ្ធិ។

២. គ្មានជនណាម្នាក់ ត្រូវបានដកហូតកម្មសិទ្ធិ តាមអំពើចិត្តឡើយ។

មាត្រា១៨

ជនគ្រប់រូប មានសិទ្ធិ សេរីភាព ខាងការគិត សតិសម្បជញ្ញះ និង សាសនា សិទញធិ នេះ រាប់ បញ្ចូល ទាំងសេរីភាព ផ្លាស់ប្ដូរសាសនា ឬ ជំនឿ ព្រមទាំង សេរីភាព សម្ដែងសាសនា ឬ ជំនឿរបស់ខ្លួន តែម្នាក់ឯង ឬ ដោយរួមជាមួយអ្នកដ៏ទៃជាសាធារណះឬជាឯកជន តាមការបង្ហាត់បង្រៀន ការអនុវត្ត ការគោរពបូជា និងការប្រតិ្តតាម។

មាត្រា១៩

មនុស្សគ្រប់រូប មានសិទ្ឋិសេរីភាពក្នុងការមានមតិ និងការសម្តែងមតិ។ សិទ្ឋិនេះរាប់បញ្ចូលទាំងសេរីភាពក្នុងការប្រកាន់មតិ ដោយគា្មនការរជ្រៀតជ្រែក និង សេរីភាពក្នុងការស្វែងរកការទទួល និងការផ្សព្វផ្សាយព័តមាន និងគំនិតនានាដោយគា្មនព្រំដែនទឹកដី ទោះតាមរយះមធ្យោបាយសម្តែងមតិណាមួយដ៏ដោយ។

មាត្រា២០

១. មនុស្សគ្រប់រូប មានសិទ្ឋិសេរីភាពក្នុងការប្រជុំ ឬការរួមគា្នជាសមាគមដោយសន្តិវិធី។ ២. គ្មានជនណាម្នាក់ ត្រូវបានបង្ខិតបង្ខំអោយចូលរួមក្នុងសមាគមណាមួយឡើយ។

មាត្រា២១

១. មនុស្សគ្រប់រូប មានសិទ្ឋិចូលរួមក្នុងការដឹកនាំកិច្ចការសាធារណះនៃប្រទេសរបស់ខ្លួនដោយផ្ទាល់ ឬ តាមរយះតំណាង ដែលបានជ្រើសរើសដោយសេរី។

២. មនុស្សគ្រប់រូប មានសិទ្ឋិចូលបម្រើមុខងារសារណះនៃប្រទេសរបស់ខ្លួន ក្នុងលក្ខខណ្ឌសមភាព។

៣. ឆន្ទះរបស់់ប្រជាពលរដ្ឋជាមូលដ្ឋានអំណាចនៃការដឹកនំាកិច្ចការ សាធារណះ។ ឆន្ទះនេះត្រូវសម្តែងចេញតាមរយះការបោះឆ្នោតទៀងទាត់ តាមពេលកំណត់ និងពិតប្រាកដ ដែលមានលក្ខណះសកល ស្មើភាព និងសម្ងាត់ ឬតាមនីតិវិធីសមមូល ដែលធានាសេរីភាពនៃការបោះឆ្នោត។

មាត្រា២២

ក្នុងឋានះជាសមាជិកនៃសង្គមមនុស្សគ្រប់រូប មានសិទ្ឋិទទួលបានសន្តិសុខសង្គម និងមានបុព្វ សិទ្ឋិសម្រេចបានសិទិ្ឋខាងសេដ្ឋកិច្ច សង្គមកិច្ច និងវប្បធម៍ដែលចំាបាច់សម្រាប់សេចក្តីថ្លៃថ្នូរ និងការរីកចំរើនដោយសេរីនៃបុគ្គលិកលក្ខណះរបសខ្លួនតាមរយះការខិតខំ របស់ជាតិនិង សហប្រតិបត្តិការអន្ដរជាតិ និង ដោយយោងទៅតាមការរៀចំនិង ធនធានរបស់ប្រទេសនីមួយៗ។

មាត្រា២៣

១. មនុស្សគ្រប់រូប មានសិទ្ធិមានការងារធ្វើជ្រើសរើស ការងារដោយសេរី ទទួលលក្ខណ្ឌ ការងារត្រឹមត្រូវ និង ពេញចត្ត និង មានការការពារប្រឆាំង នឹង ភាពអត់ ការងារ ធ្វើ។

២. មនុស្សគ្រប់រូប មានសិទ្ធិទទួលប្រាក់បៀវត្សស្មើគ្នា ចំពោះការងារដូចគ្នា ដោយគ្នាន ការរើសអើង។

៣. អ្នកធ្វើការងារ មានសិទ្ធិទទួលបានលាភការដោយសមធម៌ និងពេញចិត្ត ដើម្បីធានាអត្ថិភាព រស់នៅ រស់ខ្លួន និង គ្រួសារ ឲ្យសមស្រប នឹង សេចក្ដីថ្លៃថ្នូរ នៃ មនុស្ស និង ត្រូវ បានបំពេញ បន្ដែមទៀត ដោយមធ្យោបាយផ្សេៗ នៃការកាពារ ផ្នែកសង្គម ប្រសិន បើចាំបាច់។

៤. មនុស្ស គ្រប់រូប មានសិទ្ធិ បង្កើត សហជីព និង ចូលរួម ក្នុង សហជីព ដើម្បី ការពារ ផលប្រយោជន៏របស់ខ្លួន។

មាត្រា២៤

មនុស្សគ្រប់រូប មានសិទ្ធិឈប់សម្រាក និង លំហែកាយ កំសាន្ដ រូមបញ្ជូលទាំង កម្រិតម៉ោងការងារសមហេតុផល និង ការឈប់សម្រាកដោយបានប្រាក់បៀវត្សតាមពេលកំណត់ទៀងទាត់ ។

មាត្រា២៥

១. មនុស្សគ្រប់រូប មានសិទ្ធិ ទទួលបានកម្រិតជីវភាព គ្រប់គ្រាន់ ដើម្បីធានា សុខភាព និង សុខមាលភាព របស់ខ្លួន និង គ្រួសារ រួមមានចំណីអាហារ សម្លៀកបំពាក់ លំនៅដ្ឋាន ការថែទាំ សុខភាព និង ដរវសង្គមកិច្ច ចាំបាច់ផ្សេងៗទៀផង។ មនុស្ស គ្រប់រូប មានសិទ្ធិទទួល បានការគាំពារនៅ ពេលគ្មាន ការងារធ្វើ មានជំងឺ ពិការ មេម៉ាយ ឬពោះម៉ាយ ចាស់ជរា ឬ នៅ ពេលបាត់បង់ មធ្យោបាយធានាជីវភាព ដែលបណ្ដាលមកពីកាលះទេសៈផុតពីឆន្ទៈ របស់ខ្លួន។

២. មាតុភាព និង កុមារភាព មានសិទ្ធិ ទទួលជំនួយ និងការថែទាំពិសេស។ កុមារគ្រប់ រូប ទោះកើត ពីឪពុកម្ដាយមានខាន់ស្លា ឬ ឥតខាន់ស្លាក្ដី ត្រូវបានទទួលការកាពារខាងសង្គមកិច្ច ដូចគ្នា។

មាត្រា២៦

១. មនុស្សគ្រប់រូប មានសិទ្ធិ ទទួលបានការអប់រំ។ ការអប់រំ ត្រូវឥតបង់ថ្លៃ យ៉ាងហោច ណាស់ សម្រាប់ការអប់រំបឋមសិក្សា និង អប់រំមូលដ្ឋាន។ ការអប់រំបឋមសិក្សា គឺជាកាតព្វកិច្ច។ ការអប់រំខាងបច្ចេកទេស និង វិជ្ជាជីវះ ត្រូវ រៀបចំអោយមានជាទូទៅ។ ការអប់រំឧត្ដមសិក្សា ត្រូវបើកអោយចូលរៀន ស្មើភាពគ្នា ដោយឈរលើមូលដ្ឋាន សមត្ថភាព។

២. ការអប់រំ ត្រូវសំដៅទៅរកការរើកលូតលាស់ពេញលេញ នៃបុគ្គលិក លក្ខណះ របស់ មនុស្ស និង ការពង្រឹងការគោរពសិទ្ធិមនុស្ស និង សេរីភាព មូលដ្ឍាន ការអប់រំ នេះ ត្រូលើកកំពស់ ការយល់ដឹង ការអត់ឳនអធ្យាស្រយ័គ្នា និោង មិត្តភាព រវាង ប្រជាជាតិ និង ក្រុម ជូជសាសន៏ ឬ ក្រុម សាសនាទាំងអស់ ព្រមទាំង ការអភិវឌ្ឃន៏ សកម្មភាពរបស់ សហប្រជាជាតិ ក្នុង ការថែរក្សា សន្ដិភាព។ ៣. មាតាបិតា មានសិទ្ធិ ជាអាទិភាព ក្នុងការជ្រើសរើស ប្រភេទ នៃការ អប់រំសម្រាប់បុត្រធីតារបស់ខ្លួន។

មាត្រា២៧

១. មនុស្សគ្រប់រូប មានសិទ្ធិចូលរួមដោយសេរី ក្នុងជីវភាព វប្បធម៌ របស់សហគមន៏ អាស្រយ័ផល សិល្បះ និង ចូលរួមចំណែកក្នុងវឌ្ឍនភាព វិទ្យាសាស្រ្ដ និង ក្នុង ផលប្រយោជន៏ ដែលបានមកពីវឌ្ឍនភាពនេះ។

Of the CNRP Overseas World Conference
in the City of Atlanta, Georgia
1-2 December 2018

  • Whereas, Cambodia has fallen into the hand of a dictator, democracy and human rights have been violated and ruined by the dictatorial regime, in breach of the laws and the constitution of the Kingdom of Cambodia as well as the Paris Peace Accord enshrined on the 23rd of October 1991;
  • Whereas, the current situation as His Excellency Kem Sokha, President of Cambodia National Rescue Party is unable to exercise his expressions freely asRESOLUTION at Atlanta Georgia kh well as to conduct any decision-making on behalf of the party;
  • Whereas, the Cambodia National Rescue Party which has represented the will of more than half of Cambodian population, needs a staminal and competent leader to lead and to undertake the party strategy, and to make decisions during this transitional period;
  • Whereas, the party leadership team as of the 16th of November 2017, especially the party President, the three (3) party Vice Presidents, and the entire party institutions are not able to fulfil their roles in making party functioning after Hun Sen’s regime dissolved Cambodia National Rescue Party;
  • Whereas, the current dictatorial regime has increased pressures, threatening, and intimidating millions of supporters of the Cambodia National Rescue Party in Cambodia, to obstructing them from implementing the party’s bylaws and internal rules especially in holding a regular or special convention, or national party congress;
  • Whereas, the transitional leader must obtain good leadership qualification and prudent potential who could prove among Cambodian people and international community the credentials and leadership to accept him/her as their representative, must prove on the historical fact (towards the person who has produced great achievement in establishing and leading the party in the past) and credential fact (towards the person whom people have known well and supported the most);RESOLUTION at Atlanta Georgia kh 2As actual situation inside Cambodia, Cambodian people have been oppressed, threatened and intimidated by the dictatorial regime on a daily basis from carrying out their legitimate activities in the name of Cambodia National Rescue Party. Cambodian people living overseas who value democracy, liberty, and justice, and they have full freedom to express and rights to exercise, as well as the means to fight, they must unite to revitalize the Cambodia National Rescue Party, to initiate and undertake all types of activities in according with the principles of the Cambodia National Rescue Party aiming to bring back life of the Cambodia National Rescue Party in Cambodia.
  • Thus, the Resolution was adopted:
  1. Cambodian people must have a visionary and staminal leader in order to lead Cambodia National Rescue Party during the transitional period while HE Kem Sokha has not received full unrestricted freedom.
  2. We request HE Sam Rainsy who is a co-founder and a former President of the Cambodia National Rescue Party to be an Acting President of the Cambodia National Rescue Party in order to lead the party during this transitional period while HE Kem Sokha, the President of Cambodia National Rescue Party, is not able to lead the Cambodia National Rescue Party. This request is based on leadership of HE Kem Sokha and HE Sam Rainsy who are the only two (2) persons who have received recognition both domestic and international as the capable top leaders of the Cambodia National Rescue Party according to historical and credential fact.
  3. The position of Acting President shall become invalid when HE Kem Sokha received full unrestricted freedom.
  4. HE Sam Rainsy, in his role as an Acting President, will form the party action plans for the operation both inside and outside of Cambodia, and represents the party in communicating with institutions which have been actively seeking political solutions for Cambodia.
  5. We encourage Cambodia National Rescue Party branches overseas to create an institution with the name of Cambodia National Rescue Party Overseas (CNRP-O).
  6. Cambodia National Rescue Party branches overseas are led by a governing council comprising seventeen (17) members:

6.2 Representative branches of Cambodia National Rescue Party for the continent of Europe comprising seven (7) members.

6.3 Representative branches of Cambodia National Rescue Party for the continent of Australia and New Zealand comprising three (3) members.

The governing council of Cambodia National Rescue Party overseas shall have a Secretariat General.

The Secretariat is led by the Secretary General in the United States of America and a group of vice Secretary Generals from Cambodia National Rescue Party branches around the world.

The composition of the Governing Council and the Secretariats are selected among women and the youth.

  1. The organisation and operation of the Governing Council and the Secretariat of Cambodia National Rescue Party Overseas shall be outlined in the internal rules adopted by the Governing Council.
  2. It is noted that all opinions of President Kem Sokha shall reflect his true will when he has received full unrestricted freedom and he is able to express his opinions in public on his own.
  3. We appeal to all supporters of the Cambodia National Rescue Party of both inside and outside the country including the Cambodian people who wish to obtain positive change in Cambodia to support and actively participate in the implementation of resolution of this Cambodia National Rescue Party Overseas World Conference.
  4. The Resolution is handed to Her Excellency Mu Sochua, the Vice President of the party who has participated as an observer of the Conference to seek advice from the Party Standing (Permanent) Committee. In the event that there is no response within one week from the Party Standing Committee, this Resolution will come into effect.

This Resolution is approved by the Conference presented by chapters delegates of Cambodia National Rescue Party Overseas worldwide in the city of Atlanta, Georgia on December 2nd, 2018

European Sanctions Are a Response to Cambodia’s Totalitarian Shift

Let the Cambodia earth witness for the Sam RainsySince 2001 Cambodia has benefited from an exceptional trading advantage, granted by the European Union thanks to an initiative known as “Everything But Arms” (EBA).  This provides the possibility of exporting to Europe without quotas or customs duties. The advantage was given to a group of countries in the process of development and transition toward democracy. The intention of the European Commission was to help “least developed countries” to escape from poverty but also — a parallel, mandatory, criteria — to progress on the path to democracy and respect for human rights.

Since its creation, the EBA program has proved vital for Cambodia, whose economy is based on the export-oriented clothing industry (40 percent of GDP and 60 percent of exports). The European Union buys 40 percent of the clothes produced in Cambodia, through leading international brands.

In September, the European Union decided to begin the process of suspending Cambodia’s EBA participation because of the totalitarian drift of the regime in Phnom Penh. Under the leadership of Prime Minister Hun Sen — a former Khmer Rouge member who has been in power since 1985 — the only opposition party in parliament, the CNRP, was arbitrarily dissolved in late 2017 and its leader, Kem Sokha, arrested, while civil society organizations and the independent media were shut down. This set the scene for rigged elections in July 2018, with 100 percent of the seats in the National Assembly being won by the ruling party. Such a result demonstrates the return to a Communist-style, single-party system which the Paris Accords of 1991 intended to banish.

Beyond applying pressure for the respect of democratic principles and human rights, this threatened European sanction could kill two birds with one stone by also triggering healthy economic reforms through better governance. Cambodia is, according to Transparency International, one of the most corrupt countries in the world and, according to the World Bank, one of the poorest. The correlation between corrupt governance and poverty no longer needs to be demonstrated; the former leads directly to the latter.This totalitarian drift violates the conditions to benefit from EBA, and obliged the European Union to punish the Phnom Penh regime by suspending it. But the suspension will only be effective after a delay of 12 months, giving Hun Sen time — supposing that he has the political will — to return to the path of democracy.

The most flagrant evidence of poor governance doesn’t just lie in the systematic pillage of national wealth by an elite which clings to power indefinitely. It also consists in poor strategic decisions taken by irresponsible leaders who are incapable of a clear and coherent vision for the future of their country.

The weight of the clothing industry in Cambodia and the country’s dependence on this single industry are a striking example of this poor governance. Since the start of the process of globalization and the return of peace in the 1990s, an industrial revolution has taken place in Cambodia, driven by a clothing industry characterized by low added value and low salaries (the basic salary of a Cambodian worker is currently $170 per month). But over the last 20 to 25 years, instead of using this industry as a basis from which to diversify the economy toward higher added-value industries, the regime has allowed the national economy to become ever more dependent on a single industry. This negligence has aggravated Cambodia’s relative poverty compared to neighboring countries.

Worse, productivity within this clothing industry remains very low, meaning Cambodia can’t compete internationally without the commercial advantages provided by the European Union. Weak productivity itself reflects poor governance in the form of dilapidated public and social services, notably in health, education and professional training. Cambodia’s lack of industrial competitivity results from the corruption and negligence lamented by investors, who are faced with poor road and port infrastructure, administrative costs that include bribes to be paid at every level, exorbitant prices for state-supplied electricity, and so on.

If, to be able to survive, Cambodia’s clothing industry, a pillar of the national economy, must rely indefinitely on European trading advantages to resist competition from others who lack them, then the European Union will be subsidising and financially rewarding, through the trading system, the corruption and poor governance of the regime.

This raises the question of the effectiveness of international aid, which starts from good intentions, but has perverse effects which may do the recipient country more harm than good by helping to maintain anachronistic structures.

Faced with Hun Sen, who is holding his people hostage as part of a campaign to emotionally blackmail the international community, Europe must hold firm. The dictator has feet of clay and his days are numbered in the absence of imperative and urgent reforms.
